Terms and Conditions of Click and Sailing

By contracting any service from Click and Sailing, the client/user fully and unconditionally accepts these terms and conditions (including the section regarding privacy).

Full and unconditional acceptance of these "T&Cs" by the client/user shall be considered granted if the user has checked "I accept the terms and conditions" when creating a user account, subscribing to an offer, or making a reservation.

The service and contracting conditions go into effect at the moment the client/user generates the reservation form.

Scope of Services

Click and Sailing provides an online platform where nautical companies offer their vessels, and website clients/users can rent boats. Click and Sailing is dedicated to managing boat rental reservations (not to the provision of the lease service itself), managing the total or partial collection of said leases.

Click and Sailing acts as an intermediary between the client/user (hereinafter, "The Client") and the final service provider (hereinafter, "Nautical Company").

The client reserves a boat through the website https://www.clickandsailing.com , subsequently contracting the boat rental with the nautical company under the conditions set by said company, in exchange for the agreed-upon price. The client establishes a direct contractual relationship with the nautical company. The lease agreement is perfected between the client and the nautical company; therefore, Click and Sailing does not intervene and is not a party to it.

All vessels that appear on https://www.clickandsailing.com are offered by Click and Sailing as a mediator, and its responsibility is limited to putting the client in contact with the nautical company, which is solely and directly responsible for the provision of said service. Click and Sailing is not responsible for the provision of the service and, therefore, does not guarantee or respond for any breach or inexact fulfillment of the service contracted by the nautical company, which is the party with whom the client is contracting.

In any case, Click and Sailing requires all nautical companies to provide good service, in full compliance with industry standards and the lease agreement. Failure to meet these obligations by the nautical companies empowers Click and Sailing to cease offering these vessels.

The nautical company additionally and expressly commissions Click and Sailing to manage the total or partial collection from the client for the contracted lease services, as well as the blocking of the corresponding reservation. The contracting of other services or extras may also be charged by Click and Sailing. In the event that the nautical company requests a deposit from the client, this will be charged directly by the nautical company.

Nature of Navigation and Limitation of Liability

Click and Sailing conducts prior visits and is familiar with the vessels offered in order to ensure quality standards. However, the client is aware that navigation constitutes an adventure in itself, in which technical unforeseen events, breakdowns, or other incidents beyond our control may arise.

Click and Sailing does not assume any responsibility for the condition of the vessel, negligence, or any problem derived from its use, as the nautical company and its captain are solely responsible for the management, maintenance, and resolution of any operational incident during the trip. In the event of an incident, the client must contact the boat's captain directly to seek an immediate solution.

For our part, Click and Sailing will act as a mediator to attempt to resolve any incident with the captain or, if strictly necessary and possible, seek a replacement vessel if viable.

• IMPORTANT RECOMMENDATION (Travel Insurance): Due to the nature of these types of trips and the possibility of incidents occurring that are outside the responsibility of the vessel, Click and Sailing strongly recommends that all clients purchase their own travel insurance to cover any unforeseen events or cancellations.

The client expressly accepts this limitation of liability of Click and Sailing and that, therefore, it is only responsible for the management and formalization of the reservation of the chosen vessel, and for the management of the collection of the reservation and lease, in accordance with the established conditions and parameters and the advertised characteristics.

The nautical company is responsible for the information (prices, configuration, features, extras, etc.) included on https://www.clickandsailing.com regarding its vessels.

Click and Sailing does not verify said information and, consequently, it is the exclusive responsibility of the nautical company that this information is truthful and correct. The client accepts that any claim in this regard will be made directly and exclusively against the nautical company.

Click and Sailing does not guarantee that the boats visible on the website, nor those that the nautical company has marked as not blocked, are available. The website functions as a catalog displaying all vessels, whether they are available or not. The client will receive a confirmation email to ensure the boat's availability. A vessel is not officially confirmed until it has been paid for and the client has received a booking confirmation email.

Reservation and Contracting

The reservation process with Click and Sailing or https://www.clickandsailing.com and the subsequent contracting with the nautical company is as follows:

1. Enter https://www.clickandsailing.com

2. Select a vessel.

3. Specify the dates and, if applicable, the extras, and fill out the form.

4. Confirm the reservation details.

5. Within 24 hours, the client/user will receive confirmation from Click and Sailing as to whether the nautical company has accepted the reservation.

6. Pay (or accept the block on) the amount of the vessel lease or the portion indicated on the website.

7. The client will receive the lease agreement prepared and provided by the nautical company and all the necessary information to enjoy the rented boat.

The client acknowledges that the provision of the service will be exclusively at the expense of the nautical company, in accordance with the contract they sign, and that, therefore, the latter is solely responsible for it.

Identity Verification

Click and Sailing will not request personal or curricular documentation from clients; rather, they must provide the data and documents that the nautical company requests for the purpose of completing the lease agreement. Clients will simply be asked to fill out a form with basic data—full name, email address, and phone number—in order to communicate with them.

Obligations of the Parties

The client/user expressly accepts that:

• Click and Sailing may transmit all personal data provided to the nautical company so that it can execute the lease agreement.

• They must present the information and qualifications required of them.

• They must make payments for the amounts corresponding to the contracted services within the deadlines informed at the time of booking and/or contracting.

• They must make appropriate use of the services and, where applicable, possess the titles or licenses appropriate for the use of the vessel.

• They must pay for all services as indicated by Click and Sailing and the subsequent lease agreement, as well as those incurred during the journey that were not expressly included in the offer, such as the captain, fuel, water, moorings outside the base port, taxes, as well as all other requested services, in accordance with the lease agreement.

The nautical company commits to:

• Provide truthful and accurate information about the vessels offered on the page.

• Provide the client with the lease agreement within a maximum period of 48 hours.

• Possess all permits and licenses necessary for the development of its activity.

• Accept or reject a client's offer within a maximum period of 24 hours from the formalization of the reservation on the website.

Data Protection

In accordance with current data protection legislation, we inform you that the personal data that the client provides through any form on the website or any other means will be incorporated into a file owned by Click and Sailing for the purpose of managing the requested service and keeping you informed about other services and products that may be of interest to you.

Agreements Regarding These Rules

If any of the terms of these service and contracting conditions are declared void in application of current legislation, or by virtue of a judicial decision of a court or body with sufficient jurisdiction, the remaining terms thereof shall remain in effect.

Future Changes

Changes to the website or these conditions of use will be communicated to the client and will be considered accepted by the client if they return to https://www.clickandsailing.com after said communication.

Claims and Applicable Jurisdiction

Claims must be made in writing and via a reliable method of receipt, either at the address indicated in the first clause via postal mail, or via email to the indicated email address.
